San Donà di Piave, a Venetian company had undergone a computer fraud not indifferent, as far as the figures are concerned. Today, however, the same company has managed to get justice. Responsibilities are recognized and are the bank’s.

We know that online payments are very dangerous, even if some channels, such as bank transfers, should be safe. A very recent example is the warning from Poste Italiane on a phishing attempt, to be careful of. But let’s go back to the story of the fraud suffered in Veneto.

Bank transfer never arrived: does the bank pay?

The Venetian company that enters into the merits of this affair, had made a transfer of the amount of over 50 thousand euros, but this never reached its destination. Virtually disappeared in total darkness. As if the operation had not happened, and so the company could not make a payment to the desired supplier. The money, it turns out later, had gone straight to a foreign account, where a scammer was waiting for it.

Before explaining how the story ended, let’s explain how to act and protect yourself if they clone your card. As for the fraud suffered by the San Donà company, a rather strange thing happened once the scam was suffered. The bank in fact, at first agreed with the consumer by returning the amount, then made a reversal, recovering the amount. At that point, the company asked a lawyer for help, Luca Pavanetto, which was forced to bring the bank to the face of financial banking arbitration.

The lawyer then explained to the media: “This is yet another case in which the financial banking arbitrator confirms the account holder is right, confirming that the bank is obliged to monitor the success of the operations carried out by the user through the Home banking systems. In this case, the customer had correctly entered the IBAN on which the payment was to be directed, for which he had no responsibility; if someone, taking advantage of a flaw in the bank’s computer system, has managed to illegally intercept the sum, it is the bank’s sole task to monitor the transaction, guaranteeing the safety of operations ”.
