Bank BCA was sued by a customer because deposits were forfeited

JAKARTA. A customer sued PT Bank Central Asia Tbk or BCA for losing more than IDR 1 billion in lost deposits. Deposits at Bank BCA are considered forfeited after decades of not being disbursed.

The plaintiff is Anna Suryani, a resident of Surabaya, East Java named Anna Suryani. Anna filed a lawsuit because the money that was kept in the bank deposit was allegedly forfeited. According to the plaintiff, the total lost deposits reached more than Rp 1 billion.

Citing the Surabaya District Court Case Tracking Information System, Monday (26/10/2020), the lawsuit was registered on April 3, 2020. The first defendant is Bank BCA. Also defendants were the Regional IV Financial Services Authority (OJK) Office in the BI building on the 4th floor and the BI Regional II office in East Java Province.

The chronology of the case began when Anna Suryanti opened nine deposits in 1988 for herself and her children as provisions for the future. However, when she wanted to withdraw the deposit, Anna admitted that the deposit could not be withdrawn because it was considered expired.

Feeling that he had never withdrawn his savings, he sued Bank BCA. The trial itself is still ongoing. The trial will be held again on November 4, 2020 with an agenda for reading the witnesses of the plaintiffs.

In the lawsuit, Anna Suryani and her children said that Bank BCA had committed default. The civil lawsuit was registered at the Surabaya District Court under number 353 / Pdt.G / 2020 / PN.SBY from Anna Suryanti, Tan Herman Sutanto, Tan Johan Sutanto, and Vonny Susanty.

Still quoted from SIPP PN Surabaya, 32 years ago Anna Suryani opened 3 accounts in her name, namely Rp. 3 million, Rp. 4 million and Rp. 5 million, respectively. The date of opening a deposit account is between 1988-1990.

Meanwhile, their 3 children, Tan Hermawan Sutanto, Tan Johan Sutanto, and Vonny Susanty, were each given two deposits at BCA Bank of Rp. 4 million and Rp. 5 million in their own names. So that a total of 9 deposits were opened by the plaintiff.

In their lawsuit, Anna Suryani and her 3 children sued BCA Bank to withdraw a deposit of Rp 1.76 billion. In addition, the plaintiff also asked the court to sentence the defendant to pay material losses of Rp. 6.48 billion and to pay immaterial losses jointly and jointly with 2 other defendants of Rp. 500 million.
