The 43-year-old filed for the motion while also requesting an expedited hearing, slated to take place on July 11th, be moved up due to Boyd’s alleged refusal to allow him to see their son, Phoenix. In his court documents, Margera claims that he was never legally married to Boyd as she never changed her name. The couple had a wedding ceremony in Iceland in 2013, but it is unclear whether they ever obtained a marriage license in the United States.
Boyd’s attorney claims that the couple was under the impression that the necessary paperwork had been taken care of, and that the two lived as a married couple for years. While Margera claims that the whole divorce should be thrown out because they were never legally married, Boyd’s attorney argues that they may still be considered putative spouses under California law. The term refers to a technically invalid union where the parties believed they were married in good faith.
Boyd further accuses Margera of refusing to visit their son due to his own irresponsible behavior, including drug and alcohol abuse. The eight-year-old son of Margera’s current girlfriend is also a concern for Jess Margera, Bam’s brother. Jess has taken to Twitter to express concern for his brother’s well-being, claiming that he is unrecognizable since becoming addicted to methamphetamine.
Margera recently turned himself in after being charged with assault and making terroristic threats towards family members, leading to his release on $50,000 bail.
