Aziz Defense Coordinator: The Constitutional Council refrained from discussing our irrefutable arguments

Al-Akhbar (Nouakchott) – Former President Mohamed Ould Abdel Aziz’s defense counsel, Professor Mohameden Ould Ichdo, said that the Constitutional Council refrained from “discussing and responding to our compelling arguments,” referring to the Council’s decision on challenges to the constitutionality of legal articles.

Ould Ichdo added in an article entitled: (Preliminary Notes on the Constitutional Council’s recent decision): “The embarrassment of the editor of the Council’s decision has gone so far as not to mention our arguments and discussion, mentioning the constitutional article that we defend, the Quranic rulings and the prophetic hadiths that we made, and the comparative constitutional and legal jurisprudence that we presented.” models thereof.”

He pointed out that the council contented itself “in the operative part of its decision by saying: Article 16 of the Anti-Corruption Law does not violate the constitution, while justifying what it went to about the other two articles in the operative part of its decision!”

He added, “We were sure before we appealed that the Constitutional Council rejected our appeal of the unconstitutionality of Article 16! Despite that, we appealed in defense of our client’s interest, the supreme national interest, and the provisions of the constitution.”

A few days ago, the Constitutional Council issued a decision that Article 47 of the Anti-Corruption Law was unconstitutional, related to granting judicial and investigation agencies 10% of the confiscated judicial seizures.

The decision included rejecting the appeal submitted in Article 16 of the same law related to obligating the public official to prove the legality of his funds or convicting him of corruption, and Article 278 of the Code of Criminal Procedure related to preventing filming of trial sessions.
