This bill, baptized “for confidence in the judiciary“provides that in certain cases, professional secrecy between a lawyer and his client may be broken and that documents may possibly be seized in the course of an investigation.
“This goes from his civil status elements, to his income tax return or perhaps advice from other colleagues he could have received, especially abroad.“, explains Maître Decrock, member of the council of the Clermont-Ferrand Bar (Puy de Dome).
“A client entering a practice should feel 100% protected. We risk having clients reluctant to communicate certain information to us and thus weaken the file. Because they will not dare to say everything, considering that the cabinet could be raided“, adds the lawyer.
Supporters of the bill refer to specific cases, in cases of tax fraud or money laundering. But for lawyers, there are already many safeguards, which are more than sufficient.
