Sensational twist in the murder case of Aldo Autuoriwhich occurred in Pontecagnano Faiano on 25 August 2015. The Court of Cassation annulled the life sentence imposed on Antonio Tesonefound guilty at first instance on 15 July 2022 and sentenced on appeal on 15 December 2023. Now the case will be reviewed by the Court of Assizes of Appeal of Naples.
According to the prosecution, the murder was orchestrated to consolidate the power of the Mogavero-Bisogni clan, active in the Sele plain. Tesone was accused of having acted in collaboration with leading figures of organized crime, including Francesco Mallardo, head of the clan of the same name, the boss of Castellammare di Stabia, Luigi Di Martinoe Stefano Cecere. The assassination was apparently planned to eliminate Autuori, whose entrepreneurial activity hindered the clan’s dominance over the territory.
The reasons for the defense
The defense, represented by lawyers Dario Vannetiello and Michele Giametta, centered its strategy on challenging Tesone’s voice recognition in the wiretaps. “This is a sensational annulment – commented the lawyer Vannetiello – because the accusatory system, built by the Salerno DDA, had so far been fully accepted by the judicial authorities. All the other competitors, judged separately, with the exception of Gennaro Trambarulo, had been definitively condemned”.
The evidence collected by the investigators included messages exchanged on dedicated users, analysis of cell phones, environmental wiretaps and the statements of five justice collaborators. However, the defense highlighted “the fallacy of the judges’ reasoning” regarding the recognition of Tesone’s voice, a point considered of crucial importance.
The consequences of the verdict
The annulment by the Court of Cassation makes it impossible for the panel of the Court of Assizes of Appeal of Salerno, already involved in the previous sentence, to judge Tesone again. It will therefore be the Court of Assizes of Appeal of Naples that will review the case, after the Court of Cassation has drafted the reasons.
The murder of Autuori represented an emblematic episode of the struggle for control of the territory by organized crime in the province of Salerno. The Supreme Court’s decision, which calls into question an apparently consolidated conviction, now opens up new judicial scenarios and turns the spotlight back on an affair that has profoundly affected the local social fabric.
