What is a hit and run?
According to article L-434-10 of the Penal Code, the fact, for any driver of a vehicle or machine on land, river or sea, knowing that he has just caused or caused an accident, not to arrest and thus attempt to escape the criminal or civil liability that he may have incurred is punished by three years’ imprisonment and a fine of € 75,000. Hit-and-run is therefore a serious act, especially if the accident caused injuries, some of whom require immediate assistance.
How to react ?
It’s important to keep your cool and stop. Then, as far as possible, try to collect the following elements: the license plate, identification details of the driver and the vehicle (make, model, color, etc.). If you can, collect testimonials. Then take pictures and write down what happened.
Contact the police or the gendarmerie. If there are any injuries, notify the fire department by dialing 18 or 112 on your mobile phone.
It is necessary to declare the accident and to file a complaint against X, giving as much information as possible on the circumstances, so that the person responsible for the hit-and-run is sought. We advise you to file a complaint as soon as possible.
In order to be compensated by your insurance, send the amicable report within five working days after the occurrence of the accident. Attach the complaint and the photos taken at the scene of the accident.
What compensation?
Compensation varies depending on the type of insurance contract taken out by the hit-and-run victim. Beneficiaries of comprehensive insurance are generally compensated by their insurance, even if the person at fault has not been identified. Persons insured with a third party may obtain compensation from the Compulsory Insurance Guarantee Fund (FGAO) in the event of bodily injury and possibly damage to the vehicle, provided that there is sufficient evidence of the accident.
