Car insurance: can a vehicle not provided with a policy circulate? All the rules in force (and that we need to know) in 2023

It is the question that every motorist, every citizen, every taxpayer has asked himself at least once in his life. Do I have to pay for car insurance, even if the vehicle is stationary? The answer is not so obvious, also because, over the years, there have been many conflicting pronouncements. With 2023 just getting started, it’s good to know what you can and can’t do. Here are the current rules.

Already a few months ago, the Court of Cassation had sanctioned the obligation to pay the Rc Auto even if your car is parked in a courtyard or in a condominium parking lot. A sentence – number 21983 filed on 30 July 2022 – issued above all to protect, even before the potential perpetrators of road accidents (from their patrimonial risk), third parties damaged by accidents. However, it is not the “fault” of the Supreme Court. Because the Supreme Court has done nothing but implement the provisions of European Union law.

Directive 2009/103/EC in fact establishes that the vehicle must be covered by insurance during the period of active registration and use pursuant to article 3, first paragraph. A directive that the European Parliament approved substantially unanimously. Many citizens and families in our country own a non-running car. And that, therefore, they had to open their wallets. But in 2023 everything changes. Here’s how not to pay insurance for a non-driving vehicle. Of course, it’s all perfectly legal.

Net of the pronouncements, it is possible not to pay the insurance if the vehicle remains stationary. Obviously, as we know, the payment of the motor liability cannot be suspended in the case of leasing or if the vehicle in question is financed. Furthermore, it is good to know that if the payment is suspended, not only can the car not circulate (obviously!), but it cannot even be parked in a public area. To be able to park it in a public area it will be necessary to reactivate the policy, otherwise you risk having to pay fines ranging from from 848 to 3,393 euros. And to suffer the seizure of the vehicle.

Upon reactivation of the policy, insurance companies may require payment of the difference in the event of an increase in rates. And, in any case, the reactivation of the insurance generally involves the disbursement of an amount that is around 30 euros.

For 2023, however, it is good to know that the ban on circulating with an uninsured vehicle obviously remains active. If we don’t care and we get “caught”, the administrative fine is not insignificant and requires the payment of a sum ranging from 866 to 3,464 euros. Lastly, there is the issue of recidivism. If you run into the same measure within two years, in fact, you can also suffer the suspension of your license from one to two months, with the seizure of the vehicle.
