Authorized absence: update on leave for sick children

Back to school is over. Children and parents have (re)found their bearings. But, germs and other small viruses will also settle in and parents will have to organize themselves to look after sick children. Let’s take a quick look at their rights with our infographic dedicated to leave in the event of a sick child.

Employees are entitled to days off to care for a child under the age of 16 who is sick or has had an accident and is in their care.

The duration of the leave is 3 days per year. It is increased to 5 days:

  • if the child is less than one year old;
  • or if the employee has at least 3 dependent children (Labor Code, art. L. 1225-61).

Please note that these days are not paid, except in Alsace-Moselle.

Important

Check your collective agreement, it may provide for more favorable provisions: salary maintenance, increased number of vacation days, etc.

Leave of absence is not subject to any seniority conditions. To justify their absence, employees simply need to send you a medical certificate.

Depending on the severity of the child’s health, parents can use other leaves such as leave for family events or parental presence leave.
