KPK responds to the party’s statement Luca Enembe who argued that the Papuan people demanded that the Governor’s case be resolved using customary law. The KPK is concerned that this has an impact on the noble values of the Papuan people themselves.
“We are concerned that this counterproductive claim may actually undermine the noble values of the Papuan people themselves,” KPK news chief Ali Fikri said in his statement on Tuesday (11/10/2022).
Ali is optimistic that the leaders of the Papuan community will adhere to the noble values of adat, which have an attitude of honesty and anti-corruption. According to Ali, the indigenous Papuan people will fully support the KPK’s efforts to eradicate corruption in the Cendrawasih Land.

“We believe the leaders of the Papuan community will remain steadfast in upholding the noble values of the customs they believe in, including the values of honesty and anti-corruption. So, of course, they also fully support efforts to eradicate corruption in Papua,” he explained.
Ali then alluded to Luke Enembe’s attorney’s statement regarding customary law. Of course, Ali said, they could provide professional advice.
“Indeed, the KPK regrets the statement by the suspect’s legal counsel that he should know and understand this legal matter so that he can provide professional advice,” Ali explained.
It confirmed the existence of customary law in Indonesia. However, in corruption cases, the KPK continues to use positive laws that apply nationwide.
“But for crimes, especially corruption, both formal and material procedural law must use positive laws that apply nationally,” he said.
Ali added that even the applicable positive law will have no effect if the perpetrator has received moral and customary sanctions.
“If customary law then also imposes moral or customary sanctions on offenders, this will certainly not affect the successful law enforcement process under applicable law,” concluded Ali.
