Attorney General’s Commission Impressed Want to Protect Prosecutors Suspected of Meeting Djoko Tjandra Page all

As stated in it, the guidelines are made with the aim of providing protection to prosecutors so that they can carry out their duties without interference or from things that have not been verified, such as criminal and civil liability.

Barita does not deny that prosecutors need to be protected in their work.

However, he said, prosecuting prosecutors who committed violations should be carried out quickly and easily.

This is in order to maintain public trust in the prosecutor’s office.

However, the guidelines seem to slow down the process of prosecuting naughty prosecutors.

“When the police simplify and speed up the process of examination and supervision of persons who violate,” he said.

“How come the prosecutor’s office seems to have made guidelines that complicate and slow down the process of examining those who violate it. So this is a matter of transparency and accountability of performance, “he continued.

Reportedly, the AGO issued Guideline Number 7 of 2020 concerning the Granting of the Attorney General’s Permit for Summons, Investigations, Searches, Arrests and Detention of Prosecutors Suspected of Committing Criminal Acts.

Guideline Number 7 of 2020 was signed by Attorney General Sanitiar (ST) Burhanuddin on August 6, 2020.

“Prosecutors who are suspected of committing a criminal act, then summoning, examining, searching, arresting and detaining the prosecutor concerned can only be carried out with the permission of the Attorney General,” reads point number 1 in Chapter II of the guideline.

The guidelines also govern the procedure for obtaining permission from the Attorney General.

The board that wants to call, inspect, search, arrest and detain the said prosecutor must apply with the required documents.

The document will be examined first by the Assistant General Attorney General, Special Assistant to the Attorney General or other officials appointed by the Attorney General.

The appointed official can also coordinate with the Deputy Attorney General to obtain information on which prosecutors will be summoned or detained.

The Deputy Attorney General, can even do an exposure to get more information related to the prosecutor.

The appointed official then recommends the Attorney General to reject the permit application if the submitted documents are incomplete, inappropriate or lack urgency.

Approval or rejection of the application for the Attorney General’s license will be submitted to the applicant’s agency a maximum of two days from its issuance.

However, the Attorney General’s permission is not required for prosecutors caught in the act of committing a crime.

For prosecutors who were caught red-handed, the head of the work unit was instructed to take steps and provide legal assistance to the prosecutor.
