Attorney General Requests Lifting Immunity of People’s Representatives for Prosecution

The Attorney General Ivan Geshev submitted to the National Assembly’s registry a request to lift the immunity of two people’s representatives on the proposal of the Sofia District Prosecutor’s Office.

After checking bTV, it became clear that these are Angel Georgiev and Veselin Veshev from “Vazrazhdane”.

An indictment has been filed against the two in the Sofia District Court (SRS) for crimes committed by each of them under Art. 131, para. 2, item 4, paragraph art. 130, para. 2 of the Criminal Code (causing bodily harm to a law enforcement officer) and under Art. 325, para. 2, paragraph para. 1 NC. (the act is accompanied by resistance against an authority).

By decision of December 9, 2021, the SRS criminal proceedings in the case were suspended, as Angel Georgiev was elected as a national representative in the 47th National Assembly, and Veselin Veshev was elected as a municipal councilor.

By decision of August 16, 2022 of the same court panel, the criminal proceedings in the case were not resumed. The court’s reasons are that, although after the dissolution of the 47th National Assembly on August 2, 2022, Angel Georgiev lost the grounds for suspending the criminal proceedings, it did not for Veselin Veshev, since at that moment there was still is a person with immunity, and in order to clarify the factual situation and the proper examination of the case, the same should be heard with the participation of the two defendants.

With the decision of the CEC of April 8, 2023, the two were announced as people’s representatives and after taking the oath on April 12, 2023, they became persons with immunity.

The continuation of the criminal prosecution against the people’s representatives is possible only with the permission of the National Assembly or with their written consent, in accordance with the provision of Art. 70 of the Constitution of the Republic of Bulgaria and according to Art. 135, para. 3, cf. para. 1 of the Rules for the Organization and Activities of the National Assembly.

“Vazrazhdane” stated in a statement that “Georgiev and Veshev are not worried about giving their immunity because they are innocent”.

“We remind you that three years ago, after a protest by “Vazrazhdane” in front of the Ministry of Regional Development and Public Works (MRRD), the two were detained by the police in places far from the protest. The charges against them are for violence against uniformed persons, while the whole of Bulgaria saw footage broadcast on national television, from which it is clear that Angel Georgiev and Veselin Veshev are subject to police violence,” the party added.
