Attorney Declares Police Searches of Marion County Record and Editor’s Home as Illegitimate: Confiscated Equipment Must be Returned

Marion County, Kansas, attorney on Wednesday he said that the searches carried out on Friday by the police at the drafting of the Marion County Record, a small local newspaper in the town of Marion, and at the home of its editor and managing editor, Eric Meyer, were not substantiated by sufficient evidence and were therefore illegitimate. As a result, all confiscated equipment, including computers and mobile phones used by journalists, will have to be returned to their owners.

The search related to a complaint made by Kari Newell, a local restaurateur who accused the newspaper of illegally obtaining certain information about a 2008 conviction she received for drunk driving. Meyer had been accused of identity theft, pleading innocent.

The search was covered by many US media outlets, and regarded as an intrusion of the authorities into reporting and a violation of federal law.
