Mexico City. The Internal Control Body of the Secretariat of Public Function in the Federal Consumer Protection Agency resolved that it did not find sufficient elements to implicate Attorney David Aguilar Romero in an administrative offense, whom a former collaborator accused of alleged harassment.
The official was notified of the decision yesterday, Wednesday, by the head of the Complaints, Reports and Investigations area of the OIC, Nayeli Monserrat Moreno Camacho.
According to file 149140/2024/PPC/PROFECO/DE88, dated September 11, once the investigation was carried out and the analysis of the records that make up the case was carried out, the area “did not find suitable, appropriate or sufficient elements that allow inferring the existence of an alleged administrative fault, for which reason it determined to issue a ‘Conclusion and Filing Agreement'”
The complaint also involved other public servants of Profeco, including Emmanuel Alejandro Valenzuela Alcaraz, Diana Fabiola Piedra Flores, Ilse Mariana González Benavides and Luis Guillermo Chapa Méndez, who were also notified of the resolution by the OIC.
The document states that the investigation was carried out within the framework of the Guidelines for the attention and investigation of complaints and the Protocol for the Prevention, attention and punishment of sexual harassment and sexual harassment, published in the Official Gazette of the Federation in January 2020, documents that regulate the procedure for cases of this nature in federal agencies.
Since June, the National Human Rights Commission also determined that there was no evidence to prove human rights violations against a former collaborator of Aguilar Romero.
However, the CNDH gave notice to the OIC at Profeco to investigate possible administrative violations related to this case and also recommended that the complainant continue with the criminal complaint process that she initiated before the Attorney General’s Office and the Civil Service, and urged her to “provide the relevant evidence.”
