Associations between beekeepers and processors are included as players in interventions under Ordinance No. 8 – 2024-08-27 13:13:53


Against varroatosis, it is treated only twice – in autumn and spring

In the Ordinance promulgated today amending and supplementing Ordinance No. 8 on the interventions to the sector Beekeeping some texts are introduced that beekeepers should keep in mind.

Changes in Ordinance No. 8 (see regulation below) include as beneficiaries associations registered under the Law on non-profit legal entities for public benefit, which unite producers and processors of bee products. Until now, this type of association did not appear in the regulation.

The interventions that these associations can apply for are “Advisory services, technical assistance, training, information and exchange of good practices, including through networking, for beekeepers and beekeeping organizations” and “Promotion, communication and marketing, including market surveillance actions and activities aimed in particular at increasing consumer awareness of the quality of bee products„.

The ability to submit a separate payment application for each activity (intervention) has been corrected, with the new recorded text stating that “the applicant submits a single application for payment for all requested activities under Art. 4„.

In Art. 62, which lists the cases in which the applicant must return the aid received together with the legal interest, two points are dropped. Namely, that the aid is returned when the subject of the aided activity is changed. And when the assets acquired under the approved project are not used as intended.

The amended and supplemented regulation states that the aid against varroatosis can be applied in general and only twice – in spring and autumn.

MINISTRY OF AGRICULTURE AND FOOD

Ordinance amending and supplementing Ordinance No. 8 of 2023 on the conditions and procedures for implementing interventions from the Strategic Plan for the Development of Agriculture and Rural Areas for the period 2023-2027 in the beekeeping sector
(promulgated, SG No. 54 of 2023; amended and supplemented, Nos. 74 and 98 of 2023)

§ 1. In Art. 9, para. 4 the following changes are made:

1. In item 1, the third sentence is amended as follows: “offers must be accompanied by technical specifications;”.

2. In item 2, the first sentence is amended as follows: “in case the candidate did not choose the lowest offer, he should present a written justification for the reasons that led to his choice;”, and the third sentence is deleted.

§ 2. In Art. 12 item 7 is created:

“7. associations registered under the Law on Non-Profit Legal Entities for Public Benefit, which unite producers and processors of bee products.”

§ 3. In Art. 13, para. 1 sentence two is created: “At least one of the topics must also include Natura 2000 questions related to the objectives of the ecological network and the role of farmers in achieving them.”

§ 4. In Art. 14, para. 4, item 4, “and 7” is added at the end.

§ 5. In Art. 18 the following amendments and additions are made:

1. In al. 1:

a) in item 1, the word “licensed” is replaced by “authorized”;

b) in item 3, the word “licensed” is replaced by “authorized”.

2. In al. 2:

a) item 3a is created:

“3a. the applied for financing the VLP and funds to fight against the aggressors and the diseases in the hive are for up to two treatments of the bee families (spring and autumn), carried out in the period under Art. 5 for the relevant admission;’

b) in item 4, the words “facilities licensed to trade in LPG” are replaced by “facilities that have received permission to trade in LPG”.

§ 6. In Art. 35, para. 2, item 6, the words “small and medium” are replaced by “micro, small and medium”.

§ 7. In Art. 38 item 3 is created:

“3. associations registered under the Law on Non-Profit Legal Entities for Public Benefit, which unite producers and processors of bee products.”

§ 8. In Art. 41 para. 1 is amended as follows:

“(1) Applicants for financial assistance under the interventions of the Strategic Plan shall submit a single application for assistance and, depending on the activity for which the application is being made, attach to the Electronic Services System (ESS) the relevant documents specified in the application.”

§ 9. In Art. 51, para. 3 after the words “in case in ISAK” is added “and the Information System for the management and monitoring of funds from the European Funds under shared management”.

§ 10. In Art. 52 para. 1 is amended as follows:

“(1) In order to receive a one-time payment, the user of the aid submits an application for payment by August 31 of the current financial year and, depending on the activity for which he is applying, attaches to the SEU the relevant documents specified in the application.”

§ 11. In Art. 53 par. 2 is amended as follows:

“(2) The applicant submits a single application for payment for all requested activities under Art. 4.”

§ 12. In Art. 54, para. 1, item 4, the word “presented” is replaced by “specified”, and after the words “by the user” is added “in the application for support”.

§ 13. In Art. 57, para. 4, item 4, the word “force majeure” is replaced by “extraordinary”.

§ 14. In Art. 59, para. 1, item 3, after the words “does not cease” is added “or changes the subject of”.

§ 15. Article 62 is amended as follows:

“Art. 62. (1) The beneficiary of the assistance, who received assistance, owes a return according to the order of Art. 73 of the Law on Assistance to Agricultural Producers of amounts already paid together with the legal interest thereon, when:

1. did not fulfill its legally established or contractual obligation under Art. 58 and 59;

2. has submitted a declaration with false content and/or a document with false content, a false or forged document and/or artificially created conditions for receiving financial assistance, for extracting a benefit contrary to the requirements of this regulation;

3. has received financial assistance from another source for the activities and assets financed under the interventions under Art. 4.

(2) In the cases under para. 1, item 1, the user of the aid who received assistance owes the return of the financial aid in an amount proportional to the duration of non-fulfilment of the obligation.

(3) The period of default under para. 2 is determined from the moment of receiving the financial support until the violation is established.

(4) The amount due is calculated on a monthly basis in the amount of 1/36 of the total amount of the financial assistance paid.

(5) In the cases under para. 1, items 2 and 3, the aid user who received assistance owes the return of the entire amount of financial assistance.”

§ 16. In Art. 64 everywhere the word “force majeure” is replaced by “extraordinary”.

§ 17. In the additional provision, in § 1, item 15, the words “Force majeure” are” are replaced by “Extraordinary circumstances” may be”.

§ 18. § 2a is created in the transitional and final provisions:

§ 2a. For the financial year 2024 for the applicants for assistance with signed contracts in accordance with Art. 48, para. 6:

1. The period for incurred expenses under Art. 5, item 2 is from September 1, 2023 to September 30, 2024.

2. The deadline for submitting applications for payment under Art. 52, para. 1 is until 30 September 2024.’

§ 19. In Annex No. 1 to Art. 9, para. 1, in item IV. “Investments in tangible and intangible assets”, item 19 “Security and video surveillance system”, the following amendments and additions are made:

1. In the main text, after the word “cameras”, “connecting cable” is added.

2. Letter “g” is amended as follows:

“g) cameras, including Wi-Fi.”

Final provision

§ 20. The Ordinance enters into force on the day of its promulgation in the State Gazette.

Interventions in beekeeping are listed in Art. 4:

Art. 4. Pursuant to this regulation, financial assistance is provided for one or more activities under the following interventions:

1. “Consultancy services, technical assistance, training, information and exchange of good practices, including through networking, for beekeepers and beekeeping organizations” for the activities:

a) “Information seminars/lectures to increase knowledge on specific topics aimed at the beekeeping sector”;

b) “Demonstration activities and visits to agricultural holdings (demonstration site) for short-term exchange of experience”;

c) “Development of a handbook/handbooks for good practices, including regulatory requirements in beekeeping”;

2. “Fight against aggressors and diseases in the hive, especially against varroatosis” for the activities:

a) “Treatment of bee families against aggressors and diseases in the hive, especially against varroatosis”;

b) “Testing of bee families for the degree of parasitism with the causative agent of varroatosis – Varroa destructor”;

3. “Renewal of beehives in the Union, including bee breeding” for the activity “Renewal and/or increase the number of beehives”;

4. “Rationalization of mobile beekeeping” for the activities:

a) “Supporting the purchase of new equipment necessary for mobile beekeeping”;

b) “Reimbursement of part of the costs when practicing mobile beekeeping for the movement of bee colonies”;

5. “Investments in tangible and intangible assets” to provide technical equipment, machinery and equipment for extraction and primary processing of bee products, as well as to ensure activities related to the breeding and health of bee colonies;

6. “Actions to support laboratories for the analysis of bee products, the loss of bees or the decrease in productivity, as well as substances potentially toxic to bees” for the activities:

a) “Performance of physicochemical analysis of bee honey and bee products”;

b) “Performing analyzes for the presence of pesticide residues in food supplies, wax and bee carcasses”;

7. “Actions to preserve or increase the available number of beehives in the Union, including bee breeding” for the activity “Preservation/restoration and/or increase of the number of bee colonies”;

8. “Cooperation with specialized bodies for the implementation of research programs in the field of beekeeping and bee products” for the activity “Implementation of research projects creating added value in the field of beekeeping”;

9. “Promotion, communication and marketing, including actions for monitoring the market and activities aimed in particular at raising awareness of consumers about the quality of bee products” for the activity “Organization and holding at the national level of exhibitions, press conferences, information campaigns , festivals, fairs’.
