Asnières-lès-Dijon. Two-way radar signals the wrong vehicle

Two-way radars are not foolproof. The proof, Monday, March 8, at the Dijon police court. By peeling through her ticket, a fifty-year-old defendant found that the direction of movement of the flashed vehicle was not hers.

On the way to work in Dijon, on October 8, 2019, a nurse from Is-sur-Tille noticed that the fixed two-way speed camera in Asnières-lès-Dijon was triggered and flashed at the time same where a Citroën car crossed it on the departmental road 903. An offense which she did not impute, circulating at this moment behind a truck, between 68 and 72 kilometers per hour for 80 kilometers per hour (90 since March 2020) . However, it was she who received the fine of € 75 imputing the speed of 82 kilometers per hour (noted 86 kilometers per hour).

But Monday, at the bar of the police court, it was a rather confident defendant who maintained her position, while providing a clarification that exonerated her. The contravention notice indicated the direction of circulation Dijon – Is-sur-Tille, corresponding to the direction of the Citroën vehicle which should have been implicated. However, the fifty-year-old was heading for Dijon.

An error of interpretation recognized by the courts

The checks carried out by the representative of the public prosecutor Sébastien Tournier confirmed the position of the defendant. “You are right, there was an error in reading by the automated center for the observation of traffic violations (Cacir) in Rennes, which issued a ticket for the wrong vehicle!” He continued, showing off the photo taken by the radar.

To her relief, the defendant did not make the trip for nothing. The police court released her.
