Medicines and products whose sale is restricted to pharmacists, with the exception of the medicines and products mentioned in Article L. 5121-8, may not be sold at a price higher than that resulting from the national pharmaceutical tariff. This tariff is set by order of the ministers responsible for the economy and finance, health and social security.
Medicines appearing on the list provided for in the first paragraph of article L. 162-17 of the social security code cannot be sold to the public at a price higher than the selling price to the public defined in article L. 162- 16-4 of the same code. Where applicable, the dispensing fees mentioned in this article are added to the public sale prices of the drugs.
The first two paragraphs do not apply to drugs and products not consumed in France.
Private for-profit health establishments with a pharmacy for indoor use must apply for drugs not included in the daily prices a reduction on the limit price provided for in this article.
The minimum rate of this allowance is set by order of the ministers responsible for the economy and finance, health and social security.
