NEW YORK – A 40-year-old man from Queens was arrested in connection with the incident that killed a 5-year-old boy while trying to cross a street with his father and siblings earlier this month, the authorities Wednesday.
Xavier Carchipull, of Astoria, is accused of leaving the scene of a fatal accident and driving without a license, among other vehicle-related crimes, in the September 1 accident that killed little Jonathan Martinez just down the road where he lived from.
The boy and his family were trying to cross 100th Street in their East Elmhurst neighborhood around 5:30 pm that day, when police said a Dodge Ram truck driver headed north on McIntosh Street, where the boy resided, hit him when he was turning.
Martinez suffered severe head trauma and was pronounced dead in hospital. His parents were overcome with grief.
“I just wanted the driver to stop and not hit my son. Just stop,” Father Richard Martinez said in Spanish at the time, adding that he tried to grab all the children in the area and help them. But he couldn’t get them all to safety.
“The driver went ahead and crushed my son with both tires, and he started bleeding profusely,” said Richard Martinez, who was walking with Jonathan, a friend and the boy’s two brothers at the time of the accident.
The group had just left Helen Marshall Playground when a neighbor’s security camera footage captured the horror. The video shows three figures, the father walking hand in hand with his two young children, crossing the street in the middle of the block.
The truck then turns around and appears to hit and drag the 5-year-old for several meters. The video shows the father trying to stop the driver, but the police say the driver did not stop. Officers also said the driver did not appear to be accelerating or making illegal turns at the time of the accident.
Information from Carchipull’s attorney was not immediately available.
