Anne Auclair-Rabinovitch, president of the Grenoble judicial court, is the guest of France Bleu Isère this Tuesday, access to law day intended to make justice more accessible. 24 “justice points” have been set up with the various justice actors in the department.
All the actors of justice, magistrates, lawyers, associations, administration go to meet the public this Tuesday, May 25, day of access to the law. In Isère, around twenty “justice points” will provide free consultations. One way to bring justice closer to the inhabitants of the department, according to Anne Auclair-Rabinovitch, the guest of France Bleu Isère. She answers questions from Nicolas Crozel.
Anne Auclair-Rabinovitch, you are president of the Grenoble judicial tribunal but also president of the Departmental Council for Access to Law and that is what interests us today, since it is Access to Law Day. What does it consist of, already?
Before starting, thank you for having us. Because the idea, through you, is really to expand information, communication on this access to law. Thank you for participating in this effort. Access to law is first and foremost the right to access justice, judicial justice, as we hear most frequently. But beyond that, it’s more broadly access to all my rights, including administrative rights, including social rights, etc.
If we organize a day on access to law, does that mean that there are people who do not have access to the law, or who do not know the rights to which they could have access?
This means that the observation has been made since the 1991 law, that it is necessary to strengthen and complete the information on access to rights for these people who are in difficulty, either personally, or because they are more disadvantaged. Very clearly, because it’s complicated. Already, it is complicated to understand the legal field which is nevertheless obscure. It is more and more. It must be recognized. And then, sometimes, personal situations are extremely complex too.
Justice, which has been making educational efforts for years. A measure that is currently being debated, I do not know if you have an opinion on it, or if you can give it to me, filming trials, this is what the Minister of Justice is proposing. Could this be a way of making justice understood?
You can well imagine that I will not be able to answer you, since this is a debate which is underway in Parliament.
Do you have a duty of care?
Really, it’s more than that. We are actors, in the sense that we apply the law. But precisely, the border, it is there. We should not participate in the drafting of the law. It is really the separation of powers that is at stake in the question you are asking me.
As part of this day of access to the right of stands, today in various houses of justice, in Grenoble, in Villefontaine, “justice points”, all over the department, in the CCAS, the houses of the inhabitants. It is not in the courts, it is done on purpose, because entering a court can be scary?
Yes, it can be scary, we can say it. And then, beyond that, it is also going as close as possible to our fellow citizens, where they are used, precisely, to turn. Possibly besides, not only to ask for support, but, but also because they have their bridge club there. Yes, it’s not just going out of the walls because it’s scary. It is also to get as close as possible that these 24 justice points are installed throughout the territory of Isère and we will be led in the years to come to further develop this offer where there are very few offers of service.
What we find as information today, for example, is awareness of the mediation of justice and the conciliators of justice?
There are different sectors. I think we can say that we cover almost everything with conciliation. All these small disputes which go to the first sense of the term, really complicate your life, even rot you, and will put me in personal difficulty. But you also have family mediation. It is all these extremely sometimes explosive situations within the family, whether it is parents or children. But you also have the right of foreigners, which is still a very strong demand, and on which it is necessary to make a lot of orientation, via our essential partners who are the lawyers.
