On Wednesday, a US appeals court ruled that Apple must again limit the sale of its products that may infringe Masimo’s patents. As you probably already know, it is a duo of Apple Watch Series 9 and Ultra 2 watches. The new ban applies from Thursday, January 18, i.e. from today.

Medical accessory maker Masimo is suing Apple over two incriminating patents related to blood oxygen measurement. The technology giant was supposed to have misused Masimo’s patents for the development of its Apple Watch, especially the latest generation.

Masimo wants Apple to pull the problematic watch models from sale for the duration of the lawsuit. He doesn’t want to do that. He checked with the customs office that if he deactivates the function, he can continue to sell the watch. And that is exactly what is happening now. Apple will not officially withdraw the Watch Series 9 and Ultra 2 from sale, it will only disable the blood oxygen measurement function for them.

“Pending the appeal, Apple is taking steps to comply with the court ruling while ensuring that customers can access their Apple Watch. These steps include launching a version of the Apple Watch Series 9 and Apple Watch Ultra 2 without the Oxygen Saturation feature,” said an Apple spokesperson for the server 9to5Mac.

The app for measuring blood oxygen does not disappear from the watch, but if the user taps on it, an error message appears that “the app is not available”. Still, the ban doesn’t apply to any older generations of watches at retailers, and it doesn’t affect existing users either. It is primarily a matter of the US market, nowhere else.
