Apple has resumed selling its latest smart watches, the Apple Watch 9 and Apple Watch Ultra 2, in its stores in the United States as of Thursday, with the two watches scheduled to reappear on the company’s online store by Friday.
This step comes after the US Federal Court accepted an appeal from Apple requesting a temporary suspension of the implementation of the ban on the sale of its latest watches in its stores within the United States.
This ban came against the backdrop of a lawsuit filed by the company “Massimo” for medical technologies before the International Trade Commission (ITC), where the committee ruled that Apple violated the patents and intellectual property rights of the medical technology company, regarding the feature of measuring blood saturation with oxygen.
The lawsuit was filed in 2020, and Masimo Medical Technologies accused Apple of violating its intellectual property rights. Apple was also accused of manipulating and influencing its work teams by targeting 20 of its employees. These employees were allegedly part of the teams that separated from Masimo after the initial stages in 2013.
Many meetings were held between the two companies, and large amounts of information were exchanged. Masimo claimed that Apple took advantage of this information to develop technologies in its smart watches by including the feature of measuring oxygen levels in the blood.
This feature was launched in the Apple Watch smart watch, starting from the sixth version, which was launched in 2020, until its latest version, which was launched in September of last year.
Apple had already implemented the International Trade Commission’s decision on December 21 in its online store, and on the 26 of this month in its stores in the United States.
With the temporary suspension of the decision to ban sales, Apple’s battle against Massimo has not yet ended, as the temporary suspension will continue until the request to appeal the decision is considered.
