As Apple’s lawsuit against Epic Games continues and is expected to deliver its verdict soon, Apple has asked Judge Yvonne Gonzalez Rogers to review recent rulings the firm believes are similar to her case.
As a reminder, Epic Games attacked Apple and its App Store for antitrust reasons, notably following the removal of Fortnite from the app store.
Apple Cites FTC Against Facebook Over Judge’s Decision
So Apple asked Judge Gonzalez Rogers to review a recent court decision to dismiss the Federal Trade Commission lawsuit against Facebook.
The FTC has not pleaded enough facts to plausibly establish a necessary element of all of its Section 2 allegations that Facebook has monopoly power in the market for personal social networking services (PSN ).
We know that the judge in question can deliver her verdict at any time, and Apple therefore wants to help the alleged strategy of Facebook which would have eliminated its competition by buying WhatsApp and Instagram in particular. The Apple also highlights its recent case won against the developer of BlueMail:
Blix, a founding member of the Coalition for App Fairness, claimed that the App Store and Apple’s login authentication system were hurting competition. A judge disagreed, saying Apple is not preventing the use of other single sign-on systems. In fact, the judge went further and said that what Apple is doing is “the opposite of illegally restricting competition, so, again, Blix has not made a claim.
