Apple Faces Major Setback as Last-Generation Smartwatches Discontinued in the US Due to Patent Conflict

Major setback for Apple: from December 21, two types of last-generation Apple smartwatches will no longer be for sale in the United States. The company made this decision after a patent conflict over a sensor in the devices.

From the day after tomorrow, Apple will no longer sell Watch Ultra 2 or Series 9 smartwatches in the United States through its own webshop. Three days later, Americans can no longer go to the official Apple Stores. Apple makes that decision after an argument with another company: Fields. It has a patent on technology for blood oxygen meters.

The American International Trade Commission decided in October after a complaint from Masimo that Apple is infringing on Masimo’s patent with the Apple Watch. Masimo also claims that Apple steals employees and copies trade secrets.

Preliminary decision

The sales pause does not apply to the new Apple Watch SE, because it does not have an oxygen meter. Unofficial Apple sales channels are still allowed to sell out their stock, but cannot receive new devices for the time being. Sales in our country are not in danger for the time being, because the decision of the ITC in the US does not apply outside American territory.

US President Joe Biden could possibly reverse the ITC’s decision before December 25 with a presidential veto. This rarely happens, but is not unique: former President Barack Obama was able to prevent a ban on the iPhone 4 in this way ten years ago. But Apple has now decided to intervene earlier and take the watches off the shelves before that deadline.

In the meantime, according to Bloomberg news agency, Apple engineers are trying to adjust the algorithms for determining oxygen levels so that the Apple Watches still differ sufficiently from Masimo’s technology. But releasing such an update could take months.
