A victory of nine points out of ten is not enough for Apple, which is now appealing the verdict in the case against the game developer Epic.
The background to the quarrel is that Apple threw Epic’s game “Fortnite” from its platform after the game developer circumvented the payment model in the App store, where Apple is estimated to receive 30 percent of the profit.
Epic took it all to court and there the judge ruled Yvonne Gonzalez Rogers in Apple’s favor on nine of the ten points that Epic was outraged about. But on perhaps the most notable point, Epic was right. Apple has no right, according to Yvonne Gonzalez Rogers, to prevent app developers from encouraging users to circumvent payment in the App store in favor of their own options. Something that could potentially mean a great financial loss for the technology giant.
Epic has already chosen to appeal the verdict, but so far it has been unclear how Apple will act. The company has even called the first result a “resounding victory”.
Now it seems as if the tone has changed. According to tech site The Verge, Apple has begun the process of appealing the verdict. In the legal documents submitted for appeal, Apple refers, among other things, to the fact that allowing external payment methods in the App Store would mean that Apple could not guarantee that users are not sent to harmful sites via links that can be easily changed by unscrupulous actors.
It is unclear if, or when, the appeal will be accepted and taken up by the court.
