Appeal Trial Commenced by Yoon Seok-yeol to Cancel Disciplinary Action

In the first trial of the appeal trial filed against the Ministry of Justice by President Yoon Seok-yeol, who requested the cancellation of the two-month suspension of suspension imposed on him at the time of the Attorney General, both sides fought over the disciplinary procedure.

At the first trial of the appeal trial for the revocation of disciplinary action against President Yoon, held at the Seoul High Court Administrative Division 1-1, Attorney Kyung-Sik Sohn on the side of President Yoon said, “There is a problem with fairness in appointing and commissioning a new disciplinary committee member after the Minister of Justice requested disciplinary action.” He pointed out that ″At the time, the quorum was not enough even when the application for withdrawal from the disciplinary committee member was dismissed.″

A representative of the Ministry of Justice said, ″The minister appointing and commissioning a disciplinary member is not involved in the contents of the deliberation, but for the sake of progress.″

Previously, President Yoon was suspended from the Ministry of Justice for two months for four reasons, including writing documents on suspicion of inspections in major courts while serving as Prosecutor General, and obstructing the investigation and inspection of Prosecutor Dong-Hoon Han, who was involved in the ‘Channel A case’.

President Yoon’s side objected to this and filed a lawsuit, but the first trial court judged that the disciplinary action was justified, saying, “The two-month suspension is rather lower than the set standard as it is a serious misconduct that harms the legality and fairness of the prosecution’s work.” After a year and a half, the first appeal trial was held.

Prosecutor Han Dong-hoon, who was closest to President Yoon’s side of the investigation and inspection, became the Minister of Justice, and the Ministry of Justice replaced the lawyer who won the first trial, delaying the start of the formal trial.

In response to the point that the trial conclusion was decided without the Ministry of Justice having any intention of winning, the Ministry of Justice representative, who belongs to the Government Justice Corporation, replied, ″There seems to be a misunderstanding″ and ″I am doing my best″.

Attorney Kyung-sik Sohn on the side of President Yoon also said, ″The Ministry of Justice refuted and argued one by one in the trial.″
