Appeal rejected – Princess heir receives million compensation

Last summer, Madsen was sentenced to 45 days in prison for building a tennis court and an underground tunnel without permission in the beach zone on his own property at Hesnes in Grimstad. It happened after the Supreme Court sharpened the sentences, after treatment in two previous courts.

Hanne Madsen has always claimed that she was not informed that the work was illegal. She thus filed a lawsuit against Hemato Eiendom AS, which built the tennis court on the leisure property.

Legally binding

After losing the civil case in Aust-Agder District Court in April last year, Madsen won in the Agder Court of Appeal in March this year. The other party appealed to the Supreme Court, which has now rejected the appeal.

– The verdict is thus final, Madsen’s lawyer Erling Keyser states in a press release from Brækhus Advokatfirma on Friday.

Madsen, who is chairman of the board of Princess, is awarded compensation corresponding to the contract amount of NOK 1,090,000.

This as compensation for the losses she has suffered as a result of the tennis court being illegally constructed and that it had to be removed at the request of the municipality.

– Not in principle

Lawyer Erlend W. Holstrøm in the law firm Schjødt, represented Hemato Eiendom in connection with the appeal case.

– The Appeals Committee has not found reason to present the appeal to the Supreme Court, explained that the case has no interest in principle. We can only take note of that, says Holstrøm to Børsen.

Did not apply

The judgment from the Court of Appeal, which now stands, states, among other things, that Hemato did not comply «The duty to dissuade Madsen from constructing the tennis court without having applied for the necessary public permits. For that reason, Hemato had to assume that the service would not be of reasonable benefit to Madsen, cf. the Craftsmen’s Services Act § 7 first paragraph. »

The contractor was in contact with Grimstad municipality with questions about whether changing the cover on the lawn from natural grass to artificial grass was subject to application or not. The judgment states that the inquiry to the municipality gave an “insufficient description of the project”. Furthermore, it is stated that the description was never presented to Madsen, who thus also did not have the opportunity to correct it.

Hanne Madsen (50) is the daughter of investor Per Werner Madsen (79), who according to Capital in 2018 was good for 750 million kroner. Dagbladet wrote in 2019 that the 50-year-old had a fortune of 188 million kroner.

The Princess heir took over the idyllic property on Hesnes from his parents. Both father and daughter are extremely media-shy, and Madsen is hardly depicted or mentioned in the Norwegian media before the illegal construction case.

Madsen’s lawyer in the civil case, Erling Keyser in Brækhus Advokatfirma, says that the client is very pleased that the appeal was rejected:

– Now this process is finally over. My client is most concerned about what trap this system to the Planning and Building Act is and has been for her, he says to Børsen.
