Such a pandemic law, which must be approved by parliament, sets the contours for emergency measures such as the corona measures. The current corona measures are officially regulated by ministerial decisions and according to many, that is a mockery of the democratic rules of the game.
In the meantime, Verlinden has prepared a pandemic law, but it has still not been approved by parliament. Last Thursday, at the request of the opposition, the House decided that the Council of State should be asked again for advice. Result: another delay.
Among other things because the Council of State still has to issue an advice – but also because questions have been put to the Constitutional Court – the appeal court says that the judgment of that Constitutional Court must be awaited. “This judgment is in line with my expectations,” responds Minister Verlinden. “Over the past few months, we have consistently acted within a legal framework. The Court of Appeal reaffirms our approach today.”
