Apartment Developers 45 Noise Responses Buyers Lose Hundreds of Billions

PT Prospek Duta Sukses (PDS) opens its voice regarding complaints from unit buyers in Indonesia Apartment 45 Antasari who lost hundreds of billions. Management says development project it continues.

Prospect Duta Sukses is the developer of the 45 Antasari Apartment project.

President Director of Prospect Duta Sukses, AH Bimo Suryono, is optimistic that the project can continue because PT Indonesian Paradise Property Tbk (INPP) has entered as the controlling shareholder either directly or indirectly as of September 2021.

“The development of 45 Antasari continues with the presence of Indonesian Paradise Property as the controlling shareholder,” said Bimo in an official statement released on Friday (21/1).

According to Bimo, the presence of Indonesian Paradise Property in the company’s shareholder structure will provide certainty to buyers that the construction of Apartment 45 Antasari will not end up stalling after being abandoned by the old shareholders.

“The inclusion of Indonesian Paradise Property as a controlling shareholder is a good opportunity to work together with existing stakeholders in the completion of the 45 Antasari project,” said Bimo.

Bimo explained that his party provided relief in the installment payment process under the leadership of the new management. If according to homologation, installment payments will start on November 8, 2021, but will be changed to December 6, 2021.

In addition, Prospect Duta Sukses has also signed a partnership with PT Bank Nationalnobu Tbk and PT Bank Woori Saudara Indonesia 1906 Tbk in December 2021. This is to make it easier for buyers to continue paying for unit ownership.

Previously, buyers of apartment units who were members of the Antasari 45 Victims Association claimed a loss of up to Rp591.9 billion because the project had stalled. The loss comes from payments that have been deposited by all prospective apartment residents to Prospect Duta Sukses.

“This loss figure comes from all payments that have been paid by 775 buyers for 923 units to PT PDS as the developer of the Antasari 45 Apartment project,” wrote the Antasari 45 Victims Association in an official statement.

In 2014, the company was deemed not to have had a Building Permit (IMB) amidst the incessant marketing of residential units. Then, the developer cannot prove the progress of development physically or financially to date.

In fact, the developer has pocketed Rp591.5 billion of apartment sales money plus a loan of US$25 million from a foreign creditor, namely Ultimate Idea Limited (UIL). However, the developer still cannot continue development.

Finally, Prospect Duta Sukses was declared bankrupt in the process of Postponing Debt Payment Obligations (PKPU). In a state of bankruptcy, both parties make a peace agreement, but the agreement is considered to have violated the rules.

The peace treaty only provides two options. First, continue payments, but there is no guarantee of completion of the construction.

Second, refuse to continue the payment, but the developer will not return the money paid by the buyer before the investor bought Prospect Duta Sukses shares from the previous shareholders.
