AMLO violated impartiality in statements on the morning of February 1

Mexico City. The Specialized Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) determined that President Andrés Manuel López Obrador violated the principles of impartiality, neutrality and equity and improperly used public resources for his expressions on the morning of February 1.

At that press conference, the president made comments of an electoral nature that deviate from institutional communication; Furthermore, because the president has a higher level of care and “his freedom of expression does not have the same scope as that of people who do not hold public office,” since they are constrained to preserve impartiality in electoral processes.

“The demonstrations made made direct reference to issues of an electoral nature, by mentioning in the framework of the presentation of a series of initiatives that a qualified majority was required in the chambers of deputations and senates; that the elections were approaching, which implied vote for the party or parties, the coalition or alliances, for the candidate and also for the project. Likewise, he made reference, as a question, to the continuity of the transformation movement or the policy contrary to it.”

The three magistrates who make up this Chamber also considered that the President failed to comply with the precautionary measures in their aspect of preventive protection because he made statements of this type despite the call of the Complaints and Complaints Commission of the INE to refrain from doing so.

The head of the federal Executive cannot be sanctioned for electoral infractions, he can only be held responsible for different behaviors.

On the other hand, there were consequences for different social communication officials of the Presidency of the Republic for violating electoral principles and misuse of public resources, by organizing, producing and disseminating the morning event denounced by the PRD.

In these cases it was decided to give a hearing to the Internal Control Body of the Presidency of the Republic to determine what is legally appropriate.

The resolutions of the Specialized Chamber may be challenged before the Superior Chamber of this same TEPJF.
