AMLO orders to extinguish public trusts without organic structure

President Andrés Manuel López Obrador ordered this Thursday, through a decree published in the Official Gazette of the Federation, to extinguish all public trusts without organic structure and mandates, which represent more than 700 billion pesos.

The instruction is for dependencies and entities of the Federal Public Administration, the Office of the Presidency of the Republic, as well as the Agrarian Courts.

The disappearance of similar federal trusts in which these dependencies function as responsible units or constituents is also contemplated.

López Obrador also requested that the executors of spending not later than April 15 of this fiscal year deliver to the Treasury of the Federation all the federal public resources that these trusts have.

The executors of expenditure will also not be able to exercise or commit resources from said public trusts as of the entry into force of said decree this Thursday.

Meanwhile, the head of the Ministry of Finance and Public Credit, Arturo Herrera, will resolve the exceptions, together with the Ministry of Public Function.

“Such exceptions must be resolved upon duly justified and justified request submitted by the holder of the expenditure executor to the holder of the Ministry of Finance and Public Credit,” states the decree.

In the event that the Treasury does not authorize them within a period not exceeding 10 business days, they will be considered as not approved.

The decree does not contemplate those trusts constituted by mandate of law or decree and whose termination needs constitutional reforms.

Nor do they include legal instruments that serve as public debt mechanisms, or that are intended to attend to health emergencies or comply with labor or pension obligations.

In this regard, the head of the Ministry of Public Function, Irma Eréndira Sandoval, considered, through her Twitter account, that “in the past regime, such trusts nested corruption and were used to hide large public resources.”
