Amendments to the Lebanese Monetary and Credit Law: Implications and Concerns

“Lebanese Debate”

The cosmetic amendments that are being prepared to be introduced to the Monetary and Credit Law are not cosmetic at all, because what is proposed regarding the amendment of some articles of this law issued in the year 1964 is not limited only to amending the term of office of the Governor of the Central Bank of Lebanon and his deputies, but rather involves amending powers that fall within The core of the governor’s duties is under the title of securing balance and modernizing the law, and that is under the title of addressing the “impurities” that appeared in the criminal report in the central accounts issued recently.

The most dangerous thing about this amendment, according to well-informed accompanying sources, is that it deals with “the exclusivity of many tasks and powers of the ruler” in the Banque du Liban, on the basis of revenge against a specific sect, and not from a stage that was previously closed in the Banque du Liban.

These sources told the “Lebanon Debate” that political parties are seeking “to achieve their own interests by amending the monetary and credit law, and they are taking advantage of the criminal audit report, in order to strip the powers and tasks of the Maronite ruler, namely the head of the Supreme Banking Authority, the head of the Special Investigation Commission, and the head of the Financial Markets Authority.” , which will be withdrawn from the Maronite ruler in order to give it to other sects.”

And while the informed sources agree with the stated objectives of the committee, which is to raise the level of oversight over the functions of the Central Governor in light of the results of the previous era, they are surprised by the rhetoric of some members of the committee that bears “retaliatory” features, knowing that this page has ended and the Banque du Liban has begun a new phase with the current administration. .

Accordingly, the sources consider that the committee will not amend the Monetary and Credit Law, but rather will dismantle the Banque du Liban to turn it into an administration or institution subject to the quota of political forces, so that the Governor of the Banque du Liban becomes a mere manager and not a ruler after his powers are “dismembered”, expressing regret for the participation of some personalities. Christians in the process who willfully or unintentionally “compromise” on this issue.

These sources conclude by raising several questions about the background to the exclusion of the current acting ruler from the meetings of this committee, even though he is involved in the discussion and research in the process of amending the monetary and credit law.
