Ámbar Case: Valparaíso Regional Prosecutor dismisses Bustamante as an error | National

The Regional Prosecutor of Valparaíso, Claudia Perivancich, classified as an error that the probation commission of the Buenos Aires Court of Appeals, has granted the benefit to Hugo Bustamante, the only accused in the violation with femicide and illegal burial of Amber Dogwood.

Bustamante was convicted in 2005 of a double murder, to 27 years in jail. After 11 years in prison, and after fulfilling some legal requirements, such as learning a trade, he obtained the benefit, despite the fact that the Gendarmerie report it was unfavorable.

Faced with this, the highest authority of the Public Ministry in Valparaíso, affirmed that it is a mistake to have granted Bustamante conditional freedom.

Likewise, the persecutor said that progress should be made in implementation of enforcement courts, that is, a magistrate who is in charge of monitoring that the sentenced persons effectively comply with their sentence, either in a prison or in the free environment.

The idea of ​​advancing to the figure of a criminal execution judge began to be debated again, after the crime of Ámbar. Both criminal lawyers, such as the Minister of Justice, Hernán Larraín, and the Supreme Court itself, have been in favor of this project.

For example, in Germany, Spain and Italy they have the figure of a magistrate for the execution of sentences. In Latin America, Argentina is a sample of that.
