Silfano M. was also sentenced on appeal on Tuesday to twenty years in prison for shooting rapper Feis and the attempt to kill his brother in early 2019. Unlike the court in Rotterdam, the court in The Hague does not consider tbs necessary.
Instead of tbs, the court finds that M. should be placed under intensive supervision after his return to society. The court considers M. fully accountable.
In October 2020, the court in Rotterdam initially imposed 20 years in prison and TBS with compulsory treatment. According to the court, M. cooperated during the appeal in an investigation into his mental capacity in the Pieter Baan Center. This investigation showed that there is a risk of repetition if M. again enters a criminal environment.
In order to prevent this, the Court of Appeal considers it important that M. receives guidance during his return to society. Tbs is then not necessary, according to the court.
The shooting incident is said to be the result of an altercation between Feis (whose real name was Faisal Mssyeh), his brother and friends of M. The latter intervened in the argument by drawing his weapon and firing at both men. Feis died in hospital, his brother was seriously injured.
M. was also found guilty by the court of shooting a car in Schiedam in 2018. The incident happened after irritation had arisen about driving behaviour. The bullet landed in the driver’s seat. The passenger, an aspiring police officer, was not injured. The incident has been qualified as attempted homicide.
