The Supreme Court justices are inactive Gazalba Saleh was arrested by KPK for allegedly accepting bribes to jail Budiman Gandi Suparman for 5 years in jail. Now, the Supreme Court (MA) has reversed the review-level (PK) decision.
“Free the convict from all prosecutorial charges. It restores the convict’s rights in terms of capacity, position and dignity,” said Supreme Court spokesman Andi Samsan Nganro. detik comWednesday (28/12/2022).
The decision was drafted by the president of the assembly, Suhadi, with members Suharto and Soesilo. However, Soesilo said dissenting opinion and held that Budiman Gandhi Suparman was still guilty.
“He ordered the immediate release of the convict,” Andi Samsan Nganro said.
The following is the Supreme Court’s consideration on the release of Budiman Gandhi Suparman:
Whereas the agenda of the Annual Meeting of Members (RAT) of the Intidana Cooperative, which was held on February 27, 2016, included the determination of the sentenced PK/Appellant as General President of the Management of the Intidana Cooperative and the dismissal of the Handoko’s membership from the Intidana Cooperative. The results of the RAT are reported in the notarial deed n. 16 relating to the minutes of the annual meeting of KSP Intidana (RAT) of February 27, 2016 and in the notarial deed n. 17 relating to the minutes of the extraordinary shareholders’ meeting of 27 February 2016;
That the Extraordinary Assembly of Members of the Intidana Cooperative of 1 November 2015 and the Annual Assembly of Members of the Intidana Cooperative (RAT) of 27 February 2016 were real events and took place in accordance with the provisions of the Intidana Cooperative AD and ART, as well as the implementation and outcome of the meeting was included in the notarial deed. So that the false circumstances related to events or results of RALB and RAT activities are not met in the actions of the Applicant PK/Convict;
Given that the judex juris finding that the PK/convicted plaintiff used an authentic document which was forged proved negligence and a clear error, therefore the judex juris decision must be quashed and the Assembly in the case incasu will renew -trial declaring the PK/Convicted Plaintiff not proven to have committed an act under accusation by the Public Prosecutor.
The case started when the Intidana Special Members Meeting (RAK) chose Budiman Gandi Suparman as the general president of Intidana for 2015-2018. Budiman Gandi Suparman was later convicted on charges of forging letters.
At the Semarang District Court, Budiman Gandi Suparman was acquitted. The prosecutor then filed an appeal.
Supported by Heryanto Tanaka, the money, according to the KPK, flowed to the cassation commission. Eventually Budiman Gandhi Suparman was sentenced to 5 years in prison.
Budiman Gandi Suparman was found guilty of committing a crime using a forged authentic deed. The criminal verdict was drafted by Sri Murwahyuni e Gazalba Saleh. As for Prim Haryadi, he proposed dissenting opinion.
Subsequently, Supreme Court Justice Gazalba Saleh became a suspect in KPK corruption and was arrested. Supreme Court Justice Gazalba is suspected by the KPK of accepting bribes to jail Budiman Gandhi.
