The incident occurred in October 2021 after a prop gun held by Baldwin went off, killing Hutchins and injuring the film’s director, Joel Souza. Baldwin pleaded not guilty to the two counts of involuntary manslaughter that he faced.

Baldwin captioned his Instagram post, “I owe everything I have to this woman … (and to you, Luke).” He was referring to his wife and his lawyers, Luke Nikas and Alex Spiro who defended him throughout the case. In a statement shared with the press, Nikas and Spiro expressed their satisfaction with the decision and called for a proper investigation into the tragic incident. The Santa Fe District Attorney’s Office, which brought the charges against Baldwin, is yet to comment on the dismissal of the case.

The announcement came less than two weeks before a preliminary hearing in the case in Santa Fe, New Mexico, where it was to be determined whether there was enough evidence to take it to trial. Santa Fe district attorney Mary Carmack-Altwies and a special prosecutor, Andrea Reeb, had previously stepped down from the case. The back-and-forth between the two sides led Baldwin’s lawyers to argue that Reeb’s involvement was “unconstitutional” due to her elected position in the New Mexico House of Representatives. The DA’s office had accused Baldwin of using his “fancy attorneys” to “distract from the gross negligence” in the case.

The actor was formally charged with two counts of involuntary manslaughter by the DA in February, alongside the film’s armourer, Hannah Gutierrez Reed. The first charge required proof of underlying negligence and included a misdemeanour charge of negligent use of a firearm. The second charge included a firearm enhancement, which would have made the crime punishable by a mandatory five years in jail. The enhancement was later dropped by the DA after Baldwin’s lawyers argued that it was “unlawful”.

The DA had accused Baldwin of showing “wilful disregard” for the safety of others in the days leading up to the shooting. The DA alleged that his “reckless deviation from known standards and practice and protocol” directly caused Hutchins’ death. Baldwin also faces a separate civil lawsuit filed by the family of Hutchins who are suing the actor and the Rust movie production company for alleged battery, intentional infliction of emotional distress, negligence, and loss of consortium.

The resumption of production on the movie in Montana coincided with the dismissal of the case against Baldwin. Rust Movie Production representatives have stressed that all use of working weapons or ammunition is prohibited on set. The case has sparked discussions around the use of real guns and the safety protocols involved on film sets. It has also raised awareness of the need to prioritise the safety of all crew members during filming.
