Alec Baldwin criminal trial judge denies motion to reopen case – La Página Newspaper – 2024-09-08 21:26:22

The judge in Alec Baldwin’s criminal trial has denied a motion to revive the case.

The 66-year-old actor was on trial in July for the death of Halyna Hutchins — who was fatally shot on the set of “Rust” in 2021 — when Judge Mary Marlowe Sommer dismissed the case after his legal team argued that prosecutors had withheld evidence related to the cinematographer’s death. Now, the judge has denied a prosecution motion to revive the case.

Special prosecutor Kari T. Morrissey recently requested that the case be reconsidered. However, Judge Sommer has dismissed the petition, noting that the motion exceeds a ten-page limit on pleadings filed without permission.

In a statement given to PEOPLE, Morrissey – who has been accused of being directly involved in the decision to withhold evidence – later said: “The ten-page motion has now been filed. I cannot comment further.”

Baldwin was indicted by a New Mexico grand jury in January after the gun he was wielding during a 2021 rehearsal on the set of “Rust” went off, killing Hutchins and wounding the film’s director, Joel Souza.

The Hollywood star has since maintained that he did not pull the trigger of the gun and did not know why it contained live ammunition.

Hannah Gutierrez-Reed, the film’s gunsmith, was jailed for 18 months in April after being found guilty of charges related to the incident.

‘Rust’ has resumed filming and wrapped in May 2023. The production said in an Instagram post: “It’s been a long and difficult road. But today we’ve reached the end of the road.”
