Considering the number of endowments, documentation, and the mechanism of the endowment investment system
In its next session, the House of Representatives will discuss the request to form a parliamentary investigation committee regarding the performance of the Jaafari and Sunni Endowments Administration, submitted by Representatives Hanan Fardan, Mohsen Al-Asboul, Basima Mubarak, Mahdi Al-Shuwaikh, and Munir Sorour.
The request to form this committee came in view of the importance of the endowment from an Islamic perspective, and the great influence this importance reflects on society in all its sects, because endowments are considered a source of great revenues for social activities, and for all those who directly benefit from them, and those in need, by extension.
In order for the legitimate endowment to achieve the growth and sustainability it aspires to, there must be a specific, clear working mechanism, and a capable administration to implement this mechanism, if it exists.
The axes of the investigation include verifying the number of mosques, funerals, and cemeteries under the supervision of the two endowment departments, and the extent of the two departments’ commitment to preserving the endowment documents, and their aerial and cadastral maps.
- Verifying the number and areas of real estate and plots of land covered by the endowment system and subject to the supervision of the two endowment departments and the extent of their commitment to maintaining their endowment documents, and the methods and forms of cooperation with the relevant government agencies in this context.
- Verifying the number of endowments supervised by the Ja`fari and Sunni Endowments departments and the extent of the two departments’ commitment to documenting the endowment in each case separately.
- Verifying the extent to which the procedures for documenting and registering restricted endowments have been completed in the register of the endowment of Mr. Adnan Al-Qaruni.
- Exploring the legal system for documenting and registering endowed lands and properties, and the extent to which there are obstacles that prevent the completion of documentation and registration procedures for some of them.
- Reviewing the systems for investing and developing the endowment and the extent of the existence of legal or material obstacles that prevent the investment and exploitation of the lands and endowed properties, the maximum periods for land leasing contracts and the endowed properties, the controls for concluding these contracts, and the investment returns resulting from endowment investment in general, and their proportionality to the expenses incurred by the two departments in this regard. connection.
- Verifying the presence of violations or encroachments on lands and properties subject to the Sunni and Jaafari Endowments administrations, the measures taken to confront this, and the extent of existing legal disputes in this context.
- Verifying the presence of obstacles that prevent the documentation and registration of some endowment requests, the reasons for rejecting those requests, the legal justifications that prevent them, and the losses resulting from the presence of such obstacles.
