The Romanian army was deceived with three ships full of low-quality kerosene, according to the reasoning of the Ploiești Court of Appeal, in the case where the two defendants in the case were removed from judicial review. The final damage for the Romanian army would be over 30 million lei, or more than 6.5 million euros.
“The provisions of art. 403 C. Pen. Sanctions the acts of diversion, including the destruction, degradation or disabling in whole or in part, by any means, of the means of transport or any other asset , if the fact endangers national security. However, military combat aircraft, which have suffered serious degradation due to the refueling, during the criminal period, of an inappropriate turbojet aviation fuel, represent assets of strategic interest, the whose damage constituted a threat to the country’s security and national defense capacity, especially since it is known that within the North Atlantic Alliance, Romania has assumed the security of NATO’s eastern flank “, reads the reasoning of the court.
Compliant gochdul.ro, who presented the information exclusively, in order to maintain the seizure placed on the property of a woman, the judges of the Court of Appeal of Ploiești explained the whole mechanism of the affair through which the Ministry of National Defense was prejudiced with the amount mentioned, and several fighter jets broke down and needed repairs at Aerostar Bacău.
The judges show that on February 27, 2018, SC Jetfly Hub, led by businessman Cristian Berendel, concluded with MApN, for a period of four years, a framework agreement through which the company was to supply turbojet fuel for eight military unit aviation.
By contract, it was agreed to supply two types of kerosene, namely Jet Al and Jet Al Premium. According to the specifications, the difference between the two types of fuel was represented by the levels imposed on three parameters.
It concerns the freezing point, the concentration of aromatic hydrocarbons and the sulfur concentration of mercaptan. At the same time, both types of fuel had to contain two mandatory additives, antioxidant additive and antistatic additive respectively.
According to investigators, to gain the confidence of the army, the first transport was in accordance with the contract and was brought to the port of Constanta by the ship Evia Petrol. What the MApN representatives did not know, however, was that a Greek ship had docked in the same port long ago, since October 2017, loaded with cheap and poor quality kerosene.
Consequently, after the delivery of the first shipment, the businessmen would continue to ship to the MApN tanks in this ship. Then, according to investigators, two other ships brought kerosene processed in Greece and Turkey into the country, which did not comply with that paid by the Romanian army.
