Airbnb: The SC decides on the pretense fee – What people in the real estate market say – 2024-10-08 03:20:55

Short-term real estate rentals (Airbnb type) in Greece are on a tightrope, and this is because yesterday, for the first time, the 2nd Department of the Council of State (StE) occupied.

The Council of State is asked to decide on the self-sustaining fee for Airbnb, following the applications for the annulment of the recent circular of the Independent Public Revenue Authority (IAEA) filed by short-term property rental companies.

The relevant applications were discussed in the 2nd Department of the Council of State, which reserved itself to issue its decision in the next period.

The Association of Short-term Rental Property Companies, POMIDA and five short-term rental property companies argue that the implementation of the circular directly or indirectly affects the owners or beneficiaries involved in the management of Airbnb as they are required to pay an independent maintenance fee for each of the properties their.

They even consider the circular in question unconstitutional because, as they say, it imposes an additional tax burden (proprietary fee) on short-term real estate rental companies for each rented property, without this being provided for in a standard law provision.

This has the consequence of violating Article 87 of the Constitution and the principle of legal certainty which mandates the clear and predictable application of established regulations, such as the imposition of financial burdens in the form of taxes, fees and contributions.

Speaking to OT the president of POMIDA, Stratos Paradias, emphasized that “the act is non-existent and has no legislative authority” and underlined that “it is positive that no postponement was requested yesterday”. The circular

It is recalled that based on the AADE circular, if a legal person manages 10 properties through short-term leases in various parts of Greece, then you will pay 10 business fees. If the Legal entity, for example, manages 10 properties in an apartment building in Plaka, it will pay a registration fee.

The market is reacting strongly as it is not possible for every property that is not in the same building to be subject to a solicitation fee and be considered a branch. It is reminded that the registration fee amounts to 1,000 euros for legal entities and 600 euros for each branch.
