AirBnB Seizure: Tax Office and Financial Police Scrutiny of Bed and Breakfast Owners

It will take time, but the machine has already been started. After the maxi-seizure of 779 million ad AirBnB, the multinational of short-term rentals, the owners and managers of Bed and Breakfasts have ended up under the scrutiny of the Tax Office and the Financial Police. The check will have to be carried out contract by contract, to verify whether the flat rate tax of 21 percent on short-term rentals not paid by AirBnB as a “withholding tax” was instead paid directly by the taxpayer. Those who have not done so risk being sanctioned by the tax authorities. And it will be difficult to argue that there was “reliance” on the fact that it was the platform that paid the tax, also because it would have been enough to check the bank statements to realize that the 21 percent withholding had not been made by AirBnB. The checks, as mentioned, have already started. And they will concern a very large number of contracts. The verification should also serve to better outline the contours of the preventive seizure carried out by the Milan Prosecutor’s Office, because it is not certain that all the owners did not actually pay the tax to the State.
