AirBnb will prevent the rental of apartments that do not comply with the vacation rental law.
AirBnb abides by New York City law
New episode in the war between the city of New York and AirBnb since 2010! The town hall had adopted a new law in January 2022 which required owners to register on a short-term rental file. A law further strengthened in January 2023. And as of September 5, 2023, New York City Hall will apply the law strictly, via its Office of Special Enforcement (OSE).Result: AirBnb surrenders and announces its intention to comply with New York law to the letter. Until then, the platform closed its eyes and left owners and tourists to fend for themselves. “After doing all we can to provide a better future for home sharing, we regret to inform you that both complaints have been dismissed and that New York City will effectively ban short-term rentals,” says the platform.New York City Hall only allows short-term rentals for so-called “class B” apartments. However, this classification is carried out for an entire building, which obviously favors hotels at the expense of seasonal rentals as they existed until then. It will also be possible for owners to prohibit seasonal rentals in their entire building by simple registration in a prohibition register. The goal for the new york city hall is to severely limit the supply of rental apartments for tourists and to put apartments back on the market for New Yorkers. The real estate market remains very tense in New York and many New Yorkers have difficulty finding housing.
The new rules from September 5, 2023
What will concretely change? Starting September 5, 2023, AirBnb will modify listings that have not obtained a New York City Hall registration number so that reservations only accept long-term stays of 30 nights or more. Given the criteria put in place by New York City Hall to obtain a “Class B” classification, there should not be many ads left… if anything at all! Reservations until December 1, 2023 will not be canceled . Be careful, however, that the owner does not cancel on his side at the last moment because this arrangement of AirBnb is not in accordance with the law. The New York City Hall insists on the fact that the law is effective from September 5, 2023 and not from December 1, 2023. To cover itself, AirBnb also specifies for the attention of the owners: “We will accept all cancellations of stays scheduled to arrive from September 5th requested by hosts, without penalties or impact on Superhost status”. An owner who fears pressure from New York City Hall will therefore be able to cancel at the last moment, leaving his customers with their beaks in the water. I recommend that you exercise the greatest caution if you have a rental that no longer meets the criteria of New York City Hall. The objective of the town hall is indeed to hit hard!Reservations for short stays whose arrival date is scheduled from December 2, 2023 will be canceled and refunded in full. Also be aware that New York City Hall rules apply to AirBnb and all other sites and agencies. These are therefore the same rules for everyone, regardless of the booking site.
What solutions to rent an apartment in New York
From September 5, 2023, the only solution for renting an apartment in New York will be to spend a minimum of 30 nights there. This radically changes the game! The other solution, for a short stay, is to book an apartment in an aparthotel or in a hotel. The supply of aparthotels or rooms with kitchenettes has also developed well in recent years in New York, particularly in Manhattan. You will find several addresses of apartment hotels and hotels with kitchenettes in our list of recommended hotels in New York. Be careful, however, to book early because the demand for aparthotels is very strong. The tightening of the law and its entry into application will also constitute a breath of fresh air for hotels and aparthotels.
