Mexico City. The Argentine businessman Carlos Ahumada Kurtz, obtained a provisional suspension granted to him by a federal judge, against the order of arrest, re-arrest, appearance or detention, that any authority has issued against him.
The complainant filed the amparo claim on April 30 before the Fourth District Court of Amparo in Criminal Matters in Mexico City, which admitted it for processing. In this regard, Judge María del Carmen Sánchez Cisneros granted him the precautionary measure and also set a guarantee of 79,500 pesos, for the suspension to take effect.
“The claim for protection promoted by the legal representative of Carlos Ahumada is admitted, against acts of the Judges assigned to the Criminal Judicial Management Unit 1 of the Superior Court of Justice of Mexico City and other authorities,” the resolution states.
The judge schedules the incidental hearing for next May 8 where she will determine whether to grant the definitive suspension of the claimed acts.
It is not the first time that Carlos Ahumada promotes an amparo this year. At the beginning of April, the Argentine businessman requested the protection of federal justice after the Specialized Financial Analysis Unit (UEAF) of the Attorney General’s Office (FGR), charged him with the crime of alleged illicit enrichment.
The businessman on more than one occasion has presented various documents to recognize his lawyers and allow them to have access to the preliminary investigation AP/PGR/UEAF/030/2015-10.
Even last January, a Federal Court ratified the amparo, which Judge Celia Castellanos, head of the Tenth District Court of Amparo in Criminal Matters, granted to Carlos Ahumada, who ordered the FGR to respond to his request to be allowed have access to the preliminary investigation that was carried out against him for his probable responsibility in the aforementioned crime.
