Mexico City. Agustín Caso Raphael obtained a provisional suspension granted by a federal judge, who ordered the Superior Audit of the Federation (ASF) to keep him in the position of Special Performance auditor.
In April he was dismissed by auditor David Colmenares, after the audit on the cancellation of the New Mexico City International Airport was announced and after acknowledging before deputies that the Audit lowered the 2022 Public Account, the evaluation of the educational policy.
At that time, Caso Raphael announced that it would file “the necessary legal remedies in the face of an arbitrary and illegal decision.”
The former official filed the request for protection on May 2 before the Sixth District Court in Administrative Matters, where he challenged the official letter UGA/DGRH/DRL/045/2024, by which the cessation of his rights was communicated. appointment.
Judge Francisco Javier Rebolledo admitted the demand for guarantees to be processed and granted the provisional suspension, since the letter is not motivated, because the reasons for the loss of confidence that gave rise to the dismissal are not explained.
“It is appropriate to grant the provisional suspension requested so that the responsible authority refrains from ceasing the effects of the appointment of the complainant and continues with his functions that he performed as Special Performance Auditor of the Superior Audit of the Federation, the foregoing, by virtue of the danger in the delay and the possible impact that may be caused to the complaining party, denying the precautionary measure,” states the resolution of the justice provider.
The judge scheduled the incidental hearing for next May 13 where he will determine whether to grant the definitive suspension.
