Attorney General’s Office (AGO) investigate procurement projects satellite orbit slot 123 degrees east longitude in the Ministry of Defense (Kemhan) in 2015-2021. The Attorney General’s Office said that his party was currently investigating the case.
At a press conference held by the Attorney General’s Office, the media crew confirmed the origin of the case, it was suspected that the Ministry of Defense signed a number of contracts with private parties because they were following up on directives at the cabinet meeting. Later on its journey, it was revealed that there was an arbitration lawsuit that required the government to pay rent for the project, even though there was no budget yet.
The AGO’s Jampidsus, Febrie Adriansyah, did not explain clearly how to answer the question, but he confirmed that his party was currently investigating allegations of violating the law in this case.
“So, indeed, the handling of the case for this satellite, of course, has gone through the stages of the legal process. From the results of the investigation it is raised to an investigation. Now, if it goes up to an investigation, it means that there is sufficient preliminary evidence. We will see how to identify our fellow investigators that this was an unlawful act during the process,” said Febrie at the AGO, Jl Sultan Hasanuddin, Wednesday (19/1/2022).
The Attorney General’s Office suspects that there will be financial losses to the state as a result of an arbitration lawsuit that requires the state to pay the large amount of money. The AGO will investigate the suspect from the civilian side, while the military side will be investigated by the Military Police in collaboration with Jampidmil.
“We also believe that this has resulted in a loss, so it’s just a matter of how this is an investigation process to see who is responsible or to determine the suspect,” said Febrie.
It is known that the AGO has examined several private parties from PT Dini Nusa Kusuma and conducted a search at the office. Currently, investigators are still gathering evidence related to the case.
“As the Attorney General said earlier, now we have carried out an examination and also included a search as asked earlier that this private party is indeed a partner and executor, so investigators are exploring their role from the beginning. Is this company really considered capable when given this job,” he said.
A number of witnesses from the private sector were also questioned regarding the process of implementing the satellite project procurement. The AGO is also coordinating with the Military Police in this case.
“Then secondly, we want to see the implementation process carried out by the implementing partners as asked. Now this is still deepening and of course we will check from the implementing partners because this is the party we consider the most responsible. And this is the private sector, yes. While the military, of course, we submit it to Puspom through Jampidmil as I said from the start that we will continue to coordinate in the progress of the investigation. Including later exposure or case titles we will do after the results of the investigation we see enough so that we can determine the suspect, “he said.
Meanwhile, on a separate occasion, Dirdik Jampidsus Supardi explained that the AGO is currently investigating the alleged involvement of the private sector in the satellite procurement project. The AGO examines the private sector to explore whether the process for appointing the company has complied with the procedure or not.
“Indeed we will see later, now what is called cooperation, any contract is a tool, when behind it there is a fraud mode, used as a means to take state assets is called corruption,” said Supardi.
Even so, if corruption is proven in this case, Supardi hopes that the decision in the case will later be an effort to ease international arbitration decisions.
“Yes, at least we can seek it (lighten it), seek compensation, because we have been decided by arbitration, at least with the existence of fraud we can convey it there. loh there is fraud that’s it, said Supardi.
It is known that the Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud Md revealed that there was an alleged violation of the law behind the project in the Ministry of Defense (Kemhan) in 2015. The aftermath of the affair made the state lose.
