Attorney Karl Newole, the founder of the citizens’ list “Wie im Ersten”, who is also setting up an official liability suit for those affected, called on the government on Monday to set up a compensation fund for the victims of the Vienna terrorist attack. This would be necessary in view of the “gradually emerging fatal errors in security administration”, it said via broadcast.
One of the errors that emerged was that the Office for the Protection of the Constitution did not pass Slovak information about an attempted purchase of ammunition to the judiciary in July. If the judiciary had had this information, “it would almost certainly have been possible to arrest the later assassin on the basis of new investigations by the public prosecutor,” said Sabine Matejka, the president of the judges’ association, on Sunday in the ORF program “Im Zentrum” .

Interior Minister Karl Nehammer and Chancellor Sebastian Kurz (ÖVP) had said in the previous week that the attack could have been prevented if the perpetrator had not been released early. Matejka defended this early release once more. Granting it is not at the discretion of the court, but is provided for in the law, unless there are specific reasons against it. And only with an early conditional release can one continue to observe the offender, impose conditions on him (probation assistance, deradicalization program) and exercise a “certain control”, affirmed the judge’s president.
