The intended target is the Druze monotheist sect with all its members, symbols and even beliefs. “

Al-Murtada believed, “Such offensive actions against a sect that we value and respect cannot be tolerated. weaken our inner sphere.” Al-Murtada also emphasized that these actions are not ordinary crimes, but an increase to the level of crimes that will lead to a difficult reckoning for the person who committed the crime.

The complaint stated the following:

Crimes subject to the complaint: Carrying propaganda aimed at weakening national sentiment and inciting racial or sectarian feelings (Article 295 of the Penal Code) and promoting sectarian and racist feelings (Article 317 of the Penal Code).

First: in the facts

Amidst the flames of what Lebanon and the Lebanese are suffering from the barbaric Israeli aggression that has not saved people, heritage, or the natural environment, some open minds use speeches, blogs, and statements that they publish to public where they can, especially through the social media, in which they undermine civil peace and harm the relations of the Lebanese with each other, individuals and groups.

An example of this is what Kamal Shaitli did a few days ago, by publishing one after another on his page on the Facebook application, verbal or oral poetry in which he deliberately insults family noble spiritual Lebanon, with its members and symbols, and even its members. beliefs, because of a personal conflict that occurred between him and one of his sons, as can be seen from Tha na dáin seo as seen in the accompanying papers.

These statements have indeed left in the souls of the authorities of the Druze Unitarian sect and its members, as well as in the souls of other people, including us, a feeling of rejection and anger, and they can draw mutual reactions which may lead to undesirable. outcomes.

Since, in these special circumstances, no breach of civil peace should be tolerated, especially by using instruments of authentic Lebanese tradition such as zajal, which spread quickly among citizens, it was necessary to provide this information.

Second: In the law

Article 295 of the Penal Code mandates the following:

Whoever in Lebanon, during war or when it is expected to break out, spreads propaganda aimed at weakening national sentiment or stirring up racial or sectarian tension, will be punished by temporary arrest.

Article 317 of the Penal Code mandates the following:

Every act, every writing, and every speech which causes or causes sectarian strife or racism or incites conflict between groups and different elements of the country is punishable by imprisonment from one to three years and a fine… in addition to being prohibited from exercising the rights mentioned in the second and fourth paragraphs of Article 65 The court may order the publication of the decision.

Although the acts mentioned in the facts section fall under the scope of this article, and are a full-blown crime, they are a clear crime:

1. To all Druze family.

2. And to the Lebanese who had been moved from the areas of the Fox, by reporting them as if their hearts were filled with resentment against their brothers in the land they received, and accepted them at the height of misery.

3. And to the meaning of Lebanese life, which is based on mutual respect between groups within the framework of coexistence.

4. And to the principle of freedom, its limits are the limits of the law and the rights of other people.

Although only the above actions have continued, and will not, encourage racial and sectarian strife among the Lebanese and weaken national sentiment, at a time when they desperately need national unity, towards their criminal enemy, who rejoices in everyone. disagreements that occur between them, and which actively tries to breed internal strife and depends on This is only a trust in achieving what he was able to do in the field, so that Lebanon should not render service to the enemy which it could not accomplish. to the sacrifices of fighters and their legendary endurance on the ground. For all these reasons, we send you this complaint, requesting that the necessary steps be taken in accordance with the provisions of the law, leading to prosecution, arrest, trial and sending the severest punishments upon him.”
