The Chief Justice of the Constitutional Court (MK) Anwar Usman has been questioned by the Honorary Council of the Constitutional Court (MKMK) in relation to the alleged falsification of the decision on the judicial review of Article 23 paragraphs 1 and 2 and Article 27 A paragraph 2 of the Law on the Constitutional Court. Anwar Usman said he was waiting for the MKMK’s decision.
“Yes, that’s what was asked earlier, that’s about that. So what will the substance of the end result be, wait for the MKMK decision,” said Anwar Usman at the MK building, Jalan Medan Merdeka Barat, Central Jakarta, Tuesday (28/2/2023).
Anwar Usman said he was ready if he had to be examined again. He said he fully submitted the decision to MKMK.
“Yes, depending on MKMK, I’m ready (if examined again) as chairman, right, for example me standby continue to be at the office, come home late at night, rarely go home quickly, so it’s not because there’s an examination that’s why I just came home, no,” he said.
The inspection lasted for approximately one hour. The examination started at around 15.00 WIB.
“Yes, the question was, yes, it’s a matter of process, starting from the RPH process (deliberative meeting of judges), to pronouncing the decision on November 23, 2022,” he said.
For information, the lawsuit was filed by Zico Leonard Djagardo Simanjuntak. Zico filed the lawsuit in response to the DPR RI’s decision to replace Aswanto as a constitutional judge.
After being trialed for about half a month, the panel of judges then read out their verdict on November 23, 2022. The MK rejected the lawsuit filed by Zico and friends.
In the decision, Zico found differences in sentences between those read out by the judge during the trial and the copy of the decision uploaded on the MK website.
In the decision read out by Constitutional Justice Saldi Isra, the decision read: “Thus, dismissal of constitutional judges before the end of their term of office can only be carried out for reasons of resigning at their own request submitted to the Chief Justice of the Constitutional Court…”.
Meanwhile, in the copy of the decision uploaded to the MK website, the phrase “thus” changes to “in the future”. This change is considered important because it has an impact on whether or not the DPR RI’s decision to replace judge Aswanto is valid.
With this alleged case, the MK Honorary Council was formed on January 30 2023 with Chairman I Dewa Gede Palguna accompanied by MK judge Enny Nurbaningsih and a criminal expert from Gadjah Mada University Sudjito as its members.
