Three defendants absent and only one represented by his lawyer for a hearing between drug trafficking, vehicle destruction and chase with the police.
“The investigation began when police officers wanted to check a driver for a seat belt failure but he fled while driving dangerously, running red lights, taking streets in the wrong direction. After 30 minutes, the police put an end to the pursuit but identified the vehicle The same night, around 5 a.m., SM the owner of the car contacted the police station to report the theft of his vehicle,” explained the president of the court.
From there, he will be particularly talkative and precise and lead the police to drug trafficking: “SM indicates that he lent his vehicle to his neighbor whom he did not really know and that the latter had called him in the night to tell him about the chase and the fact that he had abandoned the car. He said he suspected him of having used it to traffic drugs.
A little later, the famous neighbor, JT appears, on foot, accompanied by an underage girl who is in possession of a piece of cannabis in a plastic bag. At the end of searches at her home and at the neighbors’ homes, €1,480 was discovered in small denominations, which the owner claimed was the product of undeclared work.
The police also discovered a cooler which contained cannabis resin and packaging bags, i.e. 130 individual sachets weighing 524 grams. The investigation will highlight a third thief, YC, in this affair where everyone passes the buck and no one takes responsibility for the traffic that was happening on Snapchat, through the resumption of an address, as the public prosecutor indicated, “in the same way as one takes over a business”.
A car destroyed by fire
SM also became a civil party since the car which had been used for trafficking and which had been chased by the police was in reality set on fire by JT and his accomplice.
For the prosecutor, there is no doubt about the guilt of the trio: “The roles are quite clear in the procedure. All the offenses are characterized concerning the different defendants. I require for YC 8 months in prison without adjustment and a €4,500 fine. For SM, 100 day fines of €10 and for JT, 6 months of detention without adjustment and a fine of €2,000.”
Me Cailleaux, in defense of SM, recalled that his client had “never varied in his statements”: “He admitted his consumption, that poses no difficulty. He admits having lent his car but did not know that he used it for this traffic Initially, he did not know He also actively participated in the investigation and, without him, there would be no file today He is at the RSA and 100 days-. fines of €10, it’s important for him.”
The court sentenced SM to 140 hours of TIG, JT to 6 months of detention and a fine of €2,000 and 6 months of prison for YC who will also have to pay a fine of €5,000.
