Afghanistan – Court prohibits deportation – Politics

An Afghan has successfully appealed to the Federal Administrative Court in Leipzig against his deportation. The reason is the poor economic situation in the country as a result of the pandemic. Because of this, even able-bodied, single adult returnees from abroad are not easily able to live with a secure existence, the court ruled on Thursday. Afghans who have been deported back to their home country are only able to “legally satisfy their most elementary needs for food, shelter and hygiene if there are special favorable circumstances”. The livelihood must be satisfied for a “foreseeable period of time”. It is not decisive whether the minimum subsistence level is sustainable or even guaranteed in the long term. The Federal Administrative Court referred the case back to the Mannheim Administrative Court, which must reassess it in the light of the decision of Germany’s highest administrative court.
