AFD Politician Roland Ulbrich Faces Criminal Complaint for Sedition and Propaganda

Ulbrich did not want to comment on the allegations when asked by LVZ. The 62-year-old is a lawyer and has a law firm in Leipzig. In addition to his state parliament mandate, he is also active in local politics as a city councilor.

The AfD state executive committee initiated party expulsion proceedings against him this week. It was said that Ulbrich had “seriously” violated party principles. “We are forced to act. Anyone who expresses themselves in an extremist manner – regardless of whether they are right-wing or left-wing extremists – is doing massive damage to the AfD,” said General Secretary Jan Zwerg.

Ulbrich resigned from party positions and left the parliamentary group

As a member of the state parliament, Ulbrich should also be excluded from the AfD parliamentary group. However, he anticipated his expulsion last Wednesday and left the group himself.

The Leipzig native also resigned from his position as Vice President of the AfD’s Federal Arbitration Court. The party said he wanted to take “responsibility for the content of an emergency decision” from the committee. This could give the impression that he “is adopting a terminology and legal principle of National Socialism with his jurisprudence”.

In the event of an indictment, the state parliament would have to revoke immunity

According to LVZ information, he is said to have used the so-called Reich Citizenship Act of 1935 (“Nuremberg Laws”) as evidence when making an arbitration award. The Nazi regulations at the time stipulated that citizens of the Jewish faith could not be considered Reich citizens. For example, Jewish civil servants had to retire and Jewish people were no longer allowed to vote.

In the case of investigations against members of the state parliament, the public prosecutor’s office must inform the president of the state parliament, who then has 48 hours to lodge an objection if necessary. However, in cases of suspected incitement, a veto is unlikely. Should there ultimately be an indictment, the state parliament would first have to decide whether immunity is lifted.

The State Office for the Protection of the Constitution in Saxony classified the AfD state association as a “right-wing extremist effort” in December 2023. The party has announced legal steps to force access to the associated report.
